These Terms and Conditions ("Terms") govern your access to and use of the Lustro.pro website (the "Website") and the pre-order services for product kits offered through it (the "Services"). The Website and Services are owned and operated by Delorenzo Marble & Stone Surfaces ("we," "us," or "our"). By accessing the Website or placing a pre-order, you agree to be bound by these Terms. If you do not agree, do not use the Website or Services.

1. Pre-Orders

Pre-orders allow you to reserve Product Kits (tools and metal edge profiles) that are made-to-order in limited production runs.

• Placing a pre-order constitutes a binding agreement to purchase the Product Kit upon availability. We reserve the right to accept or reject any pre-order at our discretion.
• Payments: A deposit (typically 50% or as specified) is charged at checkout to secure your order. The remaining balance, applicable taxes, and shipping/freight will be charged shortly before shipment (e.g., estimated September 17 or as indicated). Prices are in USD, subject to change until confirmed.
• Estimated Shipping: Dates (e.g., "Summer 2026" or specific timelines on the product page) are provided in good faith and based on current schedules. They are estimates only and not guaranteed.
• Non-Transferable: Pre-orders are non-transferable and may not be resold.
• Pre-Order Policy (integrated for clarity): All Pre-Order Kits are made-to-order in limited production runs. Deposits and payments are non-refundable except as required by law (e.g., significant delays beyond our control).Cancellations: Pre-orders are final once placed. We do not accept cancellations or refunds for change of mind, once production begins (typically after deposit receipt), or once the final balance is charged. Delays: If we cannot ship by the estimated date provided on the product page, we will notify you promptly with a revised timeline. You may then choose to cancel and receive a full refund of all payments made (processed within 7 business days). Force Majeure: Delays due to unforeseen events (supply chain disruptions, manufacturing challenges, etc.) beyond our control may occur. We will provide regular updates and extend the cancellation option if delays are substantial.After Shipment: Once shipped, items are subject to our standard return and refund policy. Deposits secure your place in production and help fund manufacturing — we appreciate your commitment to this exclusive launch!

2. Shipping, Delays, Cancellations, and Refunds (FTC Compliance)

We comply with the U.S. Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule (16 CFR Part 435):

• We ship as soon as Product Kits are available, based on estimated dates (or within 30 days if unspecified).
• All pre-order payments are generally non-refundable and pre-orders non-cancellable once placed, except as required by law.
• If unable to ship within the promised timeframe (or 30 days), we will notify you of the delay, provide a revised date (if known), and offer the option to consent to the delay or cancel for a full prompt refund.
• For the first delay (≤30 days), your silence may be treated as consent.
• For longer/indefinite/subsequent delays, we require your express consent.
• If you do not consent (or we cannot obtain it), we will cancel and issue a full refund promptly (within 7 working days, depending on method).
• You may also cancel prior to shipment if you choose not to wait.
• By placing a pre-order, you acknowledge applicable laws (including the FTC Rule) provide cancellation/refund rights for significant delays or non-delivery, even if our policy is otherwise non-refundable.

3. Payments

• Processed securely via third-party providers.
• You warrant authorization for the payment method.
• Prices exclude taxes, duties, or shipping (calculated at final charge unless stated).
• Taxes: Applicable sales taxes (based on the shipping/delivery address and prevailing rates at the time of final charge) will be calculated and confirmed shortly before shipment/delivery. Taxes will be added to the remaining balance and charged at that time. We do not calculate or charge taxes on the initial deposit.
• We may refuse/cancel orders for fraud or other reasons.

4. Shipping and Delivery

• Shipping costs are TBD (To Be Determined) for Pre-Orders and will be calculated and confirmed closer to the estimated Summer 2026 shipment date (or as updated in your order notifications). We will notify you of the exact freight/shipping amount prior to charging the remaining balance. Shipping is typically via freight carriers (LTL) for larger kits, and costs are based on final weight, dimensions (e.g., crated size), destination, and carrier rates at the time of shipment.
• Costs are calculated and charged before shipment (unless included).
• Risk of loss passes upon carrier delivery.
• We are not responsible for carrier or customs delays.

5. Limited Warranty

• Tools: Free from defects in materials/workmanship for 1 year from delivery (excludes normal wear, misuse). We will repair/replace at our discretion.
• Metal Edge Profiles: Guaranteed to match described metals/alloys.
• Warranties limited to repair/replacement; no consequential damages.
• AS IS: Except as above, Product Kits provided "as is" without other warranties (merchantability, fitness, etc.).
• Claims require proof of purchase and issue details.

6. Intellectual Property

• All Website content owned by us or licensors, protected by law.
• Limited license for personal, non-commercial viewing.
• No copying, modification, or distribution without permission.

7. User Conduct

• No unlawful use or prohibited activities (harassment, unauthorized access, etc.).

8. Disclaimer of Warranties

• Website/Services/Product Kits "as is" without warranties, except Section 5.

9. Limitation of Liability

• No indirect/consequential damages.
• Liability capped at amount paid for the pre-order.

10. Governing Law

• Governed by Delaware law (no conflict principles).
• Disputes in Delaware courts.

11. Changes to Terms

• Updates posted with new date; continued use = acceptance.
